    what if the child doesn,t want the step parent to have parental responsability

    • @woolleyandco
      @woolleyandco Год назад

      It really would depend on the child in question and the circumstances of the family. If everyone with parental responsibility agrees it is in the best interests of the child, a younger child's wishes aren't likely to be determinative. However the older the child, the more likely his or her wishes will be important if the court is asked to make a decision.

    Can you please list some examples of Unreasonable Behavior that will satisfy the court and not too inflammatory against the other parent? Please share at least 5 other than my wife won't have sex with me or sleeps in another room. Also, can you please tell me how to phrase these statements so they are not too inflammatory to my wife: 1. My wife is argumentative, does not value/acknowledge my contributions, belittles me, and does not respect or appreciate me. 2. My wife does not feel I am financially stable enough or competent and claims that I am unable to support her basic needs. 3. My wife values/favors' opinions of her friends and family over mine.

    Are the police obliged to enforce an order if the non resident parent refuses to return a child on time or sometimes at all? In this case father has residency, mother has now lost in court three times (over 7 years) and was most recently banned from applying for residency again for five years (untill youngest is 16) She refuses to return the youngest when it suits her, eldest doesn't visit mother often by choice because mother hounds the children to leave home. She kept the youngest early last year for several weeks (as soon as a 2 year banning order was up) and started picking her up from school on days she wasn't supposed to, police refused to get the child back as did social services, he ended up having to go to the school with his court papers and get the teachers to call the police on his behalf. Mother was trying to make it look like the youngest was living with her, she lied to the child saying she had already been back to court and won, she also made false abuse claims to try and get residency. She lost that case in court and recieved a further five year banning order, father is still fighting a tribunal over the benefits mother has been claiming for 18 months since these events. Benefits agency are telling him they believe the mother's claim and want him to prove his daughter lives with him, they have even told him he needs court permission to show his residency order in the tribuneral.

      It does sound like a very frustrating situation. Enforcement of child arrangement orders is by application to court. I'm going to court as my ex has kept me out of everything to do with my child she did not name me as the farther throughout the pregnancy and did not put me on the birth certificate. Now I'm taking her to court with the c63 and c100 form she gets csa to contact me saying I'm the farther. See I'm coming for a child arrangements order because I have worries about my child... Why do females think its okay to treat loving fathers like this and fight just to see there baby. Its wrong and has been happing since forever. It sickens me because we as farthers suffer at the hands of baby mummas. I for one won't give up on my child and I hope the courts back me up as my daughter would be safer with me

    What about if you don't have a solicitor and you are LIP is there still costs? For the LIP?

  • @davey1602
    @davey1602 6 лет назад

    It's worked really well in the States hasn't it? No fault divorce means you can lock a husband out of his home and call the police when he tries to gain entry. He loses his heart, kids, home, half his assets and becomes a wage slave until the children are 18 - notwithstanding any alimony that can be introduced into family court legislation at a later date. All that for a quickie divorce? I don't think so.

    • @woolleyandco
      @woolleyandco 6 лет назад

      The idea of no fault divorce does not mean any different method of dividing assets. In England and Wales, to get divorced without making allegations of unreasonable behaviour or adultery means having to wait a minimum of two years from the date you separate. Woolley & Co supports no fault divorce because at the moment a married couple who are happily divorcing have to make unpleasant allegations against the other, this can lead to unnecessary acrimony and conflict when from the outset the spouses are happy to divorce; and if they are happy to divorce they are much more likely to agree how assets are divided.

    • @davey1602
      @davey1602 6 лет назад

      So your push for no fault is for those vanishingly few occasions where the desire for divorce is mutual, rather than a whole new money maker? I never find it necessary to lie about my spouse when we can live apart for two years and achieve the same goal - giving plenty of time to get to know another prospective partner before binding myself a second time. The implication that your company encourages this kind of behaviour makes me question your adherence to the judicial system. Thank you for the information, it shows which law firm I should avoid.

    • @woolleyandco
      @woolleyandco 6 лет назад

      Our preference is for mutual divorces to be made easier, there’s no benefit to making an amicable couple start arguing and we’re not the only ones who think so. Resolution is a national body of family solicitors who are campaigning for no-fault divorce and the President of the Supreme Court Lady Hale has herself openly called for no-fault divorce. Why are divorcing couples sent to mediation at enormous expense to resolve disputes that don't exist?

    • @woolleyandco
      @woolleyandco 7 лет назад

      This isn't really the case - an attempt at mediation is only required if the couple cannot agree matters (between themselves or by negotiation), before contested court proceedings can happen.

    • @philshort3445
      @philshort3445 7 лет назад

      I'm sorry but that is the case. My wife and I were told to attend medaition at enormous cost by a solicitor even though we had agreed how to split assets. The meetings with mediation cost hundreds of pounds to achieve nothing as there was NO dispute to resolve. My wife and I are therefore very angry with the legal system and mediation who extort money from divorcing couples in a crazy attempt to resolve financial disputes that don't exist.

    • @woolleyandco
      @woolleyandco 10 лет назад

      Of course you can act in person in divorce proceedings, but many people choose to appoint a lawyer to represent them and appreciate the assistance. It would appear your friend did not get his initial advice from a suitably qualified lawyer with experience of ex-pat divorces as most people from this country will be able to divorce here. The issue of jurisdiction for divorce can be quite complicated though, and you cannot just choose to divorce in whichever country you wish.
